Fill out a block for each additional person who will drive the cart. Leave any unused blocks blank. Each driver must have a valid license and meet the age requirement.
IMPORTANT FLORIDA INSURANCE NOTICE: The valid and collectible Liability Insurance and Personal Injury Protection of any authorized rental or leasing driver is primary for the limits of liability and personal injury protection coverage required by SS.324.021(7) and 627.736, Florida Statutes.
1. Definitions. "Agreement" consists of all terms and conditions found on both sides of this form, any addenda and any additional materials we provide at the time of rental. "You" or "your" means the person identified as the renter on Page 1, any person signing this Agreement, any Authorized Renter and any person or organization to whom charges are billed by us at its or the renter's direction. "Authorized Renter(s)" means you, the renter's spouse, any additional renter(s) who have signed this Agreement, and any other driver authorized by the law of the state where the Vehicle is rented, provided that the person has a valid driver's license and is at least 22 years of age. "Vehicle" includes the automobile identified in this Agreement, any substitute, and all its tires, tools, accessories, equipment, keys and vehicle documents. "PDW" means Physical Damage Waiver.
2. Our Property. This Agreement is a contract for the rental of the Vehicle. You are not our agent. You acquire no rights other than those expressly stated in this Agreement. WE MAKE NO WARRANTIES, EXPRESS, IMPLIED OR APPARENT, REFERRING TO THE VEHICLE, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR THAT THE VEHICLE IS FIT FOR A PARTICULAR PURPOSE. We may repossess the Vehicle at your expense without notice to you, if the Vehicle is abandoned or used in violation of the law or this Agreement.
3. Prohibited Uses. The Vehicle shall not be used: (a) by anyone who is not an Authorized Driver or not licensed to drive; (b) by anyone under the influence of alcohol, prescription or non-prescription drugs; (c) by anyone who obtained the Vehicle by giving false, fraudulent or misleading information; (d) for an illegal purpose; (e) to carry persons or property for hire; (f) to tow or push anything; (g) in a race or speed contest; (h) to teach anyone to drive; (i) outside the geographic area described elsewhere in this Agreement; (j) on an unpaved surface; (k) when the odometer has been tampered with; (l) when continued operation would damage it; (m) by anyone lacking manual-transmission experience where applicable; (n) to transport an animal (other than a service animal); (o) to carry more passengers than seatbelts; (p) by anyone sending text/SMS messages or emails while operating the Vehicle. Smoking is not permitted in the Vehicle.
4. Breach of Agreement; Unauthorized Use. If you violate any term of this Agreement, you will be liable for all damage to and loss of use of the Vehicle. Any breach also voids any insurance coverage.
5. Condition and Return of Vehicle. Renter must return the vehicle to our rental office at the date and time specified. The vehicle remains subject to this Agreement until it has been inspected and accepted by us. If returned after hours, renter is still responsible for any damage including theft until inspected and accepted on the next business day.
6. Responsibility for Damage or Loss. If you do not accept and pay for PDW, or if PDW is voided, you are responsible for all missing equipment, damage to, or loss of, the Vehicle, loss of use while it is being repaired, diminution of value, and all administrative costs we incur, regardless of fault.
7. Insurance. RENTER AGREES TO MAINTAIN AUTOMOBILE INSURANCE during the term of this rental agreement, including: (a) bodily injury and property damage liability; (b) personal injury protection / no-fault where required; (c) uninsured/underinsured coverage where required; (d) comprehensive and collision damage extending to the rental vehicle.
8. Charges. You will pay us on demand for time and mileage; PDW (when accepted); fuel if returned with less than rented; applicable taxes; loss of or damage to the Vehicle; all fines, penalties, towing charges and other expenses involving the Vehicle assessed against us during your rental; all costs we incur in locating and recovering the Vehicle; collection costs and attorneys' fees; 1.5% per month interest on unpaid balances; and $2/mile if the vehicle is returned or abandoned away from the renting location.
9. Deposit. We may use your deposit to pay any amounts owed to us under this Agreement.
10. Your Property. You release us, our agents and employees from all claims for loss of, or damage to, your personal property or that of any other person, whether or not caused by our negligence.
11. Modifications. No term of this Agreement can be waived or modified except by a writing that we have signed. To extend the rental period, the Vehicle must be returned for inspection and written amendment of the due-in date.
12. Miscellaneous. No waiver by us of any breach constitutes a waiver of any additional breach. If any provision is deemed unenforceable, the remaining provisions are valid. This Agreement constitutes the entire agreement between you and us.
13. Examination Under Oath (EUO). Renter, additional renters, and any other drivers or passengers must submit to an examination under oath to help with the investigation of any claim or accident at the request of the insurance company.
14. Physical Damage Waiver. By entering this rental agreement you may be liable for damage, loss, or loss of use to the rental vehicle. Where allowed by law, this contract offers a PDW for an additional charge to cover all or part of your responsibility. PDW is not insurance and is not mandatory. PDW is void if you fail to call police to an accident, fail to report accidents within 24 hours, fail to pay rental charges, or drive in any unauthorized manner including: by an unauthorized driver, under the influence of drugs/alcohol, by fraud, for illegal purposes, for hire, towing, racing, teaching to drive, carrying dangerous items, outside the US/Canada, overloaded, on unpaved roads, over seat-belt capacity, transporting children without approved safety seats, with tampered odometer, or by any wanton or reckless act.
